Italian football giants overturn UEFA ban with our support
Northridge represented AC Milan at the Court of Arbitration for Sport (CAS) in July 2018 to successfully overturn their ban from European football.
The seven-time European Cup winners were challenging UEFA’s decision to ban them from European competition for season 2018/19 for breaches of the Club Licensing and Financial Fair Play Regulations. AC Milan’s legal team at CAS also included Lévy Kaufmann-Kohler and Gianni, Origoni, Grippo, Cappelli & Partners.
Milan successfully overturned the ban that had been issued by the Adjudicatory Chamber of the UEFA Club Financial Control body. The club did not contest UEFA’s finding that it had breached the break-even requirement of the FFP regulations under its previous ownership, but successfully argued that the Adjudicatory Chamber had failed to assess certain relevant facts correctly.
CAS ordered that the case be referred back to UEFA for the governing body to issue a proportionate decision, determining that UEFA should undertake a contemporaneous analysis of the club’s financial circumstances (i.e. taking into account the change in the club’s financial position brought about following its change of control).
